1. About these terms
These terms apply to services provided by AVIR It Pty Ltd (ABN 86 703 571 822, ACN 703 571 822) and to your use of avirittec.online. By engaging us or using this website, you agree to these terms. "We", "us" and "our" mean AVIR It Pty Ltd; "you" means the person or business engaging us.
2. Quotes and scope of work
Before starting a job we agree the scope of work and the expected cost with you, usually by email. If we find during the job that more work is needed, we will stop and ask before going beyond the agreed scope. Estimates are our best assessment from the information available and may change if the problem turns out to be different from what was described.
3. Your responsibilities
- Give us accurate information about the problem and the devices or accounts involved.
- Make sure you own, or are authorised to let us work on, those devices, systems and accounts.
- Back up important data before work begins where you are able to. If you cannot, tell us and we can discuss a backup as part of the job.
- Hold valid licences for any software you ask us to install or configure.
- Provide safe access to your premises for on-site work.
4. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Services must be provided with due care and skill, be fit for any purpose you made known to us, and be supplied within a reasonable time. For major failures with a service, you are entitled to cancel your service contract and obtain a refund for the unused portion, or compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded.
5. Fees and payment
Fees are as agreed in your quote or estimate. Unless otherwise agreed, invoices are payable within 14 days of issue. Parts, licences or subscriptions bought on your behalf are charged at the cost agreed with you before purchase.
6. Third-party products and services
Hardware, software and online services made by others are covered by their own terms and manufacturer warranties. We will help you make a warranty claim where we can, but we are not responsible for the performance, availability or security of third-party products beyond our own guarantees under the ACL.
7. Limitation of liability
To the extent permitted by law, and subject always to the ACL guarantees described above:
- where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again;
- we are not liable for indirect or consequential loss, including loss of profits or business interruption, except where that loss was reasonably foreseeable and caused by our failure to exercise due care and skill;
- we are not liable for loss caused by information you gave us that was inaccurate, or by your failure to follow our reasonable written advice.
8. Intellectual property
The content and design of this website belong to AVIR It Pty Ltd and may not be copied or reused without our written permission. Written job summaries, documentation and configurations we prepare for you become yours to use once the related invoice is paid. Third-party software remains subject to its own licence terms.
9. Cancellation and termination
You may cancel a booked job by email before work begins without charge, unless parts or licences have already been bought for you at your request. Either party may end an ongoing arrangement by written notice. If an arrangement ends, you pay for work completed up to that point, and we return any of your equipment, credentials and documentation in our possession. We may stop work if continuing would be unlawful or unsafe, or if an invoice is significantly overdue after a written reminder.
10. Use of this website
